The Capital Area MPO coordinates transportation planning in Wake County and portions of Franklin, Granville, Johnston, and Harnett counties.  The public is encouraged to speak at both the Transportation Advisory Committee and the Technical Coordinating Committee meetings.  There is an opportunity for the public to comment on agenda items at the beginning of each meeting.  When speaking please tell us your name and place of residence; please limit comments to three minutes per speaker.

4.       Approval of Minutes of February 15, 2006 TAC Meeting.

 

The minutes of the February 15, 2006 TAC meeting, Attachment 4A, will be distributed at the meeting.

5.       FY 2006-2007 Unified Planning Work Program

 

Annually, the Capital Area MPO is required to prepare a Unified Planning Work Program (UPWP) which details and guides the urban area transportation planning activities.  Funding for the UPWP is provided by the Federal Highway Administration (FHWA), the Federal Transit Administration (FTA), as well as state and local governments. The UPWP identifies yearly funding allocations to support the ongoing transportation planning activities of the MPO.  The UPWP must identify MPO planning tasks to be undertaken with the use of federal transportation funds.

 

Areas of emphasis for development of the UPWP were noted from the TCC (February 2005) and TAC (October 2005) planning retreats.  Those areas of emphasis have been reviewed and included in the draft 2006-2007 UPWP as appropriate.

 

Staff of the Capital Area MPO, the Durham-Chapel Hill-Carrboro MPO, Triangle J Council of Governments, and the Triangle Transit Authority met on Friday, January 20, 2006 to discuss coordination of joint work tasks and plans for their inclusion in

 

the upcoming UPWP.  The UPWP subcommittee for the Capital Area MPO met on February 9, 2006 and teleconferenced on February 20, 2006 to review a draft UPWP for tasks specific to the Capital Area MPO and tasks that are to be undertaken in cooperation with the agencies listed above. Discussion of work activities presented in the draft FY 2006-2007 UPWP was also held at the February 2, 2006 and March 2, 2006 TCC meetings. 

 

The UPWP is being presented today for review and comment.  Any comments received will be reviewed and included as appropriate, the document will then be presented to the TCC on April 7, 2006 with the expectation that it will be forwarded to the TAC with a recommendation of approval at the April 19, 2006 TAC meeting.

 

The Draft FY 2006-2007 UPWP is enclosed as Attachment 5A.

 

TAC Action:  Receive draft FY 2006-2007 UPWP for review and comment as appropriate and authorize release for minimum 30 day public comment period, to conclude April 19, 2006. Schedule hearing to receive comments on the FY 2006-2007 UPWP to be conducted at the TAC meeting on April 19, 2006.

 

 

6.       Self-Certification Review

 

The Capital Area MPO annually conducts a self-certification review as part of approving its Unified Planning Work Program.  The self-certification process takes the form of the Capital Area MPO TAC adopting a resolution that self-certifies that the MPO is fulfilling all federal requirements for the transportation planning processes.  A checklist of items reviewed during this process is enclosed as Attachment 6A.  The resolution self-certifying the MPO is fulfilling all requirements for the transportation planning process as put forth by the Federal guidelines is enclosed as Attachment 6B.

 

TAC Action: Adopt Resolution of Self-Certification that the MPO is fulfilling all federal requirements for the transportation planning processes.     

 

 

7.       Capital Area MPO Public Involvement Process

 

In February of 2005, a federal MPO certification review was performed, the results of which indicated that our MPO should evaluate its current public involvement process, with more frequent reviews.  These reviews would assist with modification of the process, as needed, with the goal of improving public outreach, particularly to minority and low-income (MLI) communities. As a result of these review recommendations, the Capital Area MPO TAC approved conducting a review of the MPO’s public involvement processes on an annual basis, to be done in concert with

 

each year’s UPWP development effort.  This year, the public involvement process was reviewed and modifications were suggested.  These modifications include the following:

 

1.     The public involvement process shall be reviewed annually by MPO staff, the TCC, and the TAC.

 

2.      A 45-day public comment period will be required if changes are made or if the document has not been revised in three (3) years. 

 

3.     The Long-Range Transportation Plan (LRTP) will be available for public comment for 45 days prior to approval.

 

4.     Addition of language that clarifies the role of member governments in advertising public meetings and the opportunity for public comment during planning activities including (but not limited to) LRTP, Metropolitan Transportation Improvement Program (MTIP), Unified Planning Work Program (UPWP), Air Quality Conformity Determination, and other development processes

 

5.     Updated the list of newspapers that will receive press releases,

 

6.     Changed the number of legal notices required for the MTIP and the LRTP. 

 

7.     Addition of language that requires notification, as necessary, of additional media contacts and non-governmental contacts that represent minority and environmental interests.

 

A copy of the Capital Area MPO Public involvement Process (with proposed revisions highlighted) is enclosed as Attachment 7A.

                                                                               

 

TAC Action:          Receive updated Capital Area MPO Public Involvement Process and authorize release for 45 day public comment period and set hearing, to receive public comment, to be conducted during May 17, 2006 TAC meeting.

 

 

8.       US-1 Corridor Study Update

 

The US-1 Corridor Study is underway.  Several meetings of the Oversight Team and Technical Oversight Committee have been held.  At the February 21, 2006 meeting, a newsletter which will be mailed to interested or affected parties along the corridor was distributed.  A copy of the newsletter will be distributed at the March 2, 2006 meeting.  Mr. Chip Russell, TCC Chair, will present an update on the progress of this study. A copy of the US-1 Corridor Newsletter is enclosed as Attachment 8A.

 

TAC Action:  Receive update on US-1 Corridor Study.

 

 

9.       US 1 / New Falls of Neuse Boulevard Right-of-Way

 

During the US 1 North Corridor Study Oversight Committee meeting on February 21, 2006, information came to light regarding land previously reserved by the Wakefield development for the future construction of a single-point urban diamond interchange and related roadway improvements in the area of the intersection of US 1 and New Falls of Neuse Boulevard.  Information regarding the history of this parcel and recent NCDOT actions follows.

 

On May 13, 1999, NCDOT and Wakefield Commercial, LLC and Effell, LLC entered into an agreement whereby by the end of 2002, NCDOT would purchase right of way located along the southeast corner of the Wakefield development adjacent to the intersection of US 1 and New Falls of Neuse Boulevard.  That date expired without NCDOT having completed the purchase; however, the reservation of right of way remained in place.  On May 18, 2005 a letter was sent from NCDOT to the parcel owner withdrawing its “offer to purchase” the right of way property (Attachment 9A) and on December 16, 2005 a second letter (Attachment 9B) was sent to the developer’s agent by NCDOT stating that the property is “no longer needed” by the Department and the owners were being released from their obligation of reservation.  These letters were sent to various NCDOT staff; however, apparently no one at the MPO or the City of Raleigh (who secured the reservation as a condition of approval of the Wakefield development) were notified.

 

At its meeting on March 2, 2006, the TCC reviewed this matter and recommended sending a letter to NCDOT Secretary Tippett, expressing several concerns, including;

 

  • Loss of opportunity to secure right-of-way needed for constructing an interchange at this major intersection on US 1, one of NCDOT’s most important Strategic Highway Corridors, as called for in the Long-Range Transportation Plan.

 

  • Lengthy amount of time taken by NCDOT to negotiate purchase of right-of-way after the STIP and MTIP were amended in November 1992 to include funds for this right-of-way purchase.

 

  • Difficulty in protecting right-of-way needed for future highway improvements if right-of-way purchases such as these are not carried out in a timely fashion.

 

  • Lack of notice by NCDOT to either MPO or City of Raleigh of actions to be taken, either before or after the fact.

 

TAC Action:  Receive information on US-1 right of way issue for discussion and action as appropriate.

 

 

 

 

 

10.     US 64 West Corridor Study – Phase 2

 

The North Carolina Department of Transportation, in cooperation with the Capital Area MPO, Town of Apex, and Town of Cary, is preparing to conduct a second phase of the US 64 West Corridor Study beginning in FY 2007.  This phase of the study project focuses on development of an access management plan along US 64 from US 1 in Cary to the eastern end of the Pittsboro Bypass, in Chatham County.  This plan will identify transportation and land development strategies, including interchanges, local access streets and access management and implementation strategies, needed to transform the roadway from its existing state to a more effective free-flowing highway utilizing freeway, expressway, and super-street design concepts.  Mr. David Wasserman of NCDOT’s Transportation Planning Branch, will address the TCC on the scope and current status of this study.
